South African Regulators Form Alliance to Supervise Digital Gambling Marketing

South Africa’s National Gambling Board (NGB) and Advertising Regulatory Board (ARB) have executed a Memorandum of Understanding (MoU) to establish a coordinated framework for monitoring gambling advertising across digital and traditional media channels. The inter-agency agreement creates formal protocols for joint market surveillance, technical data exchange, and inter-regulatory complaint referrals, specifically targeting illicit marketing campaigns originating from unlicensed cross-border gambling operators.

Strategic Focus on Digital Platforms and Off-Shore Targeting

The regulatory initiative addresses the rapid expansion of digital gambling promotions across social media networks, affiliate marketing websites, and influencer partnerships. Under the terms of the agreement, the NGB and ARB will synchronize oversight across emerging digital channels alongside traditional broadcast and print media.

Beyond domestic market supervision, the collaboration establishes operational mechanisms to identify and suppress promotional campaigns conducted by offshore operators lacking valid licenses in South Africa. By sharing technical expertise and consumer protection data, both regulatory bodies aim to disrupt the marketing funnel that directs domestic consumers toward unauthorized gambling platforms.

Complaints Protocol and Legislative Mandates

The MoU formalizes a bilateral complaint-referral process allowing disputes to be transferred between the NGB and ARB based on statutory jurisdiction. Under the framework, consumer and competitor complaints regarding misleading, predatory, or unauthorized marketing will undergo joint technical evaluation under both the South African Code of Advertising Practice and federal gambling statutes.

The regulatory push aligns with ongoing enforcement under Section 15 of South Africa’s National Gambling Act, 2004 (Act No. 7 of 2004). The statutory provision strictly prohibits false or misleading promotional claims, bans marketing aimed at minors, and mandates the inclusion of clear responsible gambling disclaimers and support resources across all public promotional assets.

To assist consumers in identifying legitimate platforms, the NGB maintains an active Verified Operator Portal, while both entities plan to roll out joint public awareness campaigns outlining consumer rights and warning against illegal online gambling platforms.
